• Clery Act

  Who Must Report?

  Campus Security Authorities (CSA)

  • Members of the Department of Public Safety/KUPD;
  • Individuals who have responsibility for campus security other than the KUPD, including, but not limited to Security Guards Incorporated employees, residence hall desk receptionists, recreation center facility monitors and building supervisors, and student union and library staff;
  • Individuals or organizations specified in KU’s statement of campus security policy as an individual or organization to which students and employees should report criminal offenses; and
  • University officials who have significant responsibility for student and campus activities, including, but not limited to, student housing staff, advisors to campus student organizations, coaches and trainers of athletic teams, and staff members of the Dean of
    Students Office who participate in student judicial proceedings.

  What Must Be Reported?

  • Criminal Offenses;
  • Hate Crimes;
  • VAWA Offenses; and
  • Arrests and Referrals for Disciplinary Action.

  Reporting Process

  • A crime is considered "reportable" when it is brought to a CSA's attention.  KU affiliation of the victim or reporting party is not required.
  • Immediately fill out a Campus Security Authority Incident Report Form and submit the completed form to Public Safety.
  • Always include the type of crime and the location.

• Protection of Minors

  Who Must Report?

  All employees, independent contractors, and official university volunteers must make a report.

  What Must Be Reported?

  Known or suspected acts of physical abuse, sexual abuse, emotional or mental abuse, and/or neglect of a minor, under the age of eighteen (18).

  Reporting Process

  • Call 9-1-1 for acts, in progress;
  • For completed acts, an immediate oral report to the Department of Human Services (DHS) ChildLine at 1-800-932-0313 or in written form (CY-47 form) using electronic technologies.
  • If an oral report is made, a written report must be made within 48 hours to DHS; and
  • Immediately following the report to DHS, the reporter must notify the Vice President for Compliance, Equity & Liaison for Legal Affairs/Title IX Coordinator, Mr. Jesus Peña, Esq.

• Title IX

  Who Must Report?

  Responsible Employees

  An employee who:

  • Has the authority to take action to redress sexual violence;
  • Has been given the duty of reporting incidents of sexual violence or any other misconduct by students to the Title IX Coordinator or other appropriate school designee; or
  • Is an individual who a student could reasonably believe has this authority or duty.

  *All Kutztown University employees are responsible employees.

  What Must Be Reported?

  All allegations of sexual violence, domestic violence, dating violence, and/or stalking of a University student or employee.

  Reporting Process

  • Must be reported immediately to:
    • Mr. Bradley Davis, Esq., Director of Equity and Compliance, and Title IX Coordinator; and
    • Mr. David Drezek, Chief of Police.
